# Terms of Service

These Terms of Service ("Terms") govern your use of **Socials** (the "Bot"), a Discord bot that allows users to add social links and custom titles to their Discord profile and/or server, which are stored and associated with your Discord user ID or server ID. The Bot is operated by **Novinity** ("we," "us," or "our").

By inviting the Bot to a server, or by interacting with the Bot's commands, you agree to be bound by these Terms. If you do not agree, do not use the Bot.

## 1. Eligibility

You must meet Discord's own minimum age requirement (currently 13 years old, or the applicable age of digital consent in your country) to use Discord and, by extension, the Bot. By using the Bot, you represent that you meet this requirement.

## 2. Description of Service

The Bot allows users to:

- Add, edit, or remove social media links and custom titles associated with their Discord profile (user ID).
- Add, edit, or remove social media links and custom titles associated with a Discord server (server/guild ID), subject to that server's own permission settings.

This data is stored in a database and linked to the relevant Discord user ID or server ID so it can be retrieved and displayed by the Bot.

## 3. Acceptable Use

When using the Bot, you agree that you will not:

- Submit links to content that is illegal, malicious (e.g., phishing, malware, scam links), sexually explicit, or that violates Discord's [Terms of Service](https://discord.com/terms) or [Community Guidelines](https://discord.com/guidelines).
- Impersonate another person, brand, or entity, or submit titles/links intended to mislead or deceive other users.
- Attempt to abuse, exploit, reverse-engineer, or interfere with the Bot's normal operation (e.g., spamming commands, attempting injection attacks, or attempting to access data that is not yours).
- Use the Bot to harass, threaten, or harm any individual or group.
- Submit content on behalf of a server without the appropriate permissions to do so.

We reserve the right to remove any submitted link, title, or other data that violates these Terms, without notice.

## 4. Server Administrators

If you add the Bot to a Discord server, you are responsible for ensuring that server members' use of the Bot complies with these Terms and with your own server rules. Server administrators may configure which roles can add or edit server-level links and titles, where such controls are provided by the Bot.

## 5. Data Storage

Use of the Bot involves storing certain data (such as your Discord user/server ID and the links/titles you submit) in our database. Details of what is collected and how it is used are described in our [Privacy Policy](http://cdn.novinity.dev/legal/socialsbot/PRIVACY_POLICY.md).

## 6. Availability and Modifications

We aim to keep the Bot available and functioning, but we do not guarantee uninterrupted or error-free service. We may:

- Modify, suspend, or discontinue the Bot (or any part of it) at any time, with or without notice.
- Update these Terms from time to time. Material changes will be reflected by updating the "Last Updated" date above. Continued use of the Bot after changes take effect constitutes acceptance of the revised Terms.

## 7. Termination

We may suspend or terminate your (or your server's) access to the Bot at any time, for any reason, including violation of these Terms, without prior notice. You may stop using the Bot at any time by removing it from your server and/or requesting deletion of your data (see the Privacy Policy for details).

## 8. Disclaimer of Warranties

The Bot is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Bot will be secure, error-free, or continuously available.

We are not responsible for the content of any external links submitted by users through the Bot. Links are provided by users, not verified or endorsed by us, and you access them at your own risk.

## 9. Limitation of Liability

To the fullest extent permitted by law, Novinity shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of, or inability to use, the Bot.

## 10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of **Australia**, without regard to its conflict of law principles.
